courts are calculated according to JVEG.<\/p><p>The JVEG is a German law that regulates the remuneration and compensation of persons who work within the framework of the judiciary, in particular experts, interpreters, witnesses and other persons who act on behalf of the judiciary.<\/p><p>The JVEG sets out the principles and rules for the remuneration of these people who, for example, appear as experts in court, testify as witnesses or act as interpreters.<\/p><p>It contains detailed provisions on the level of remuneration, travel costs, expenses and other aspects that must be taken into account when compensating people in the context of justice.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1b1e4f3 elementor-widget data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The current Judicial Procedure Act (JVEG) dates from April 2025 and entered into force on June 1, 2025. The judiciary has taken into account a so-called &#8220;judicial discount&#8221; of 5%, arguing that the state is &#8220;a good client.&#8221; <\/p><p>The legislature wants experts to bill their time expenditure to the minute.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e77c913 elementor-widget elementor-widget-heading\" data-id=\"e77c913\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h4 class=\"elementor-heading-title elementor-size-default\">Hourly rates for \u201cexpert reports, court costs\u201d<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b147067 elementor-widget elementor-widget-text-editor\" data-id=\"b147067\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The hourly rates in the JVEG from 2021 should represent the average hourly rates in the respective specialist area from 2018. Then a discount of 5% was also taken into account.<\/p><p>It is not known when the new hourly rates in the JVEG, effective June 2025, were established. Based on experience, they are likely already a few years old. <\/p><p>The costs for court reports are therefore based on hourly rates that are too low.<\/p><p>The <a href=\"https:\/\/www.gesetze-im-internet.de\/jveg\/BJNR077600004.html\" target=\"_blank\" rel=\"noopener\">different hourly rates<\/a> for the many subject areas are contained in \u201cAnnex 1 to Section 9 Paragraph 1 Sentence 1 JVEG\u201d.  <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-adb0ec3 elementor-widget elementor-widget-heading\" data-id=\"adb0ec3\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h4 class=\"elementor-heading-title elementor-size-default\">Hourly rate for \u201cmachinery and systems\u201d<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7b5de0e elementor-widget elementor-widget-text-editor\" data-id=\"7b5de0e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p class=\"MsoNormal\">According to Section 24.4, including the judicial discount, the hourly rate valid since June 2025 is \u20ac142.00 net. This rate is significantly lower than for expert opinions for industry, commercial enterprises, and insurance companies. <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3eea810 elementor-widget elementor-widget-heading\" data-id=\"3eea810\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h4 class=\"elementor-heading-title elementor-size-default\">Hourly rate according to JVEG \u00a713 paragraph 1 or paragraph 2<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ef70d31 elementor-widget elementor-widget-text-editor\" data-id=\"ef70d31\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>According to JVEG \u00a713 para. 1 request a higher hourly rate. Finally, in 2018, the respective \u201c <em>average hourly rate<\/em> \u201d for experts was determined for different specialist areas.<\/p><p>You can see that the price increases in the comparison between 2023 and the year of the survey were already almost 20%.<\/p><p>The hourly rate according to JVEG for experts in the area of \u200b\u200b\u201c <em>machinery and systems<\/em> \u201d was determined to be \u20ac130.00 net, with reference to the supposedly determined average hourly rates for 2018, including the judicial discount. Without the judicial discount, this average rate would have been \u20ac136.50 in 2018. I do not know of anyone who, as <a href=\"https:\/\/maschinenkanzlei.de\/en\/technical-expert\/\" data-wpil-monitor-id=\"78\">an expert witness<\/a> in 2018, only claimed an hourly rate of \u20ac136.50 net for party reports in mechanical engineering. The hourly rates for full-time and professional experts were already higher in the \u201cmachinery and systems\u201d area.<\/p><p>The vertical line in Figure 1 indicates the starting point of the current JVEG. Taking into account the price increases, the hourly rate should have been significantly higher, even with a \u201cjudicial discount\u201d, based on the average costs determined. Court hourly rates should already be significantly higher due to the <a href=\"https:\/\/maschinenkanzlei.de\/en\/expert-opinion-court-costs\/\">cost increases since 2020<\/a> . Then the topic is often about the following questions:<\/p><ul><li>What is the cause of the damage?<\/li><li>Who is responsible for that?<\/li><li>How high is the amount of damage?<\/li><\/ul><p>In analogy to industrial companies and commercial enterprises, the hourly rates are also higher than according to the JVEG in the court order.<\/p><p>Most insurance adjusters offer slightly lower hourly rates than commercial and industrial companies.<\/p><p>This has the following reasons:<\/p><ul><li>Insurance companies are very often regular customers who commission on a regular basis.<\/li><li>Insurance companies very rarely have the time pressure that almost always exists when carrying out expert work for business and industry.<\/li><li>The liability risk is higher than in court orders, but lower than in orders from industrial companies and commercial enterprises.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section As a rule, the dispute is not only about a <a href=\"https:\/\/maschinenkanzlei.de\/en\/product-liability-for-machines-product-defects\/\" data-wpil-monitor-id=\"158\">product defect in a machine<\/a> , but in most cases, loss of profit is also taken into account because the machine or system could not be used or could only be used to a limited extent due to the alleged defect. If you lose as a party in the first instance with a dispute amounting to \u20ac1 million, the legal cost risk is around \u20ac45,000.<\/p><p>In addition, Figure 4 shows the estimated costs for an expert report in mechanical engineering in the range of amounts in dispute up to \u20ac3 million. A minimum value is given (\u201cSV-MIN\u201d) and an estimated maximum value (\u201cSV-Max\u201d) in the event that the expert report becomes extensive or relatively costly due to the effort involved.<\/p><p>The estimated maximum value (\u201cSV-Max\u201d) takes into account the worst case scenario with the highest costs based on experience. You can also see here that the relatively \u201ccertain\u201d costs for an expert report are significantly lower than the costs for the litigation cost risk in the first instance. Just in case it is one<\/p><ul><li>technically complicated case<\/li><li>extensive evidence and thus<\/li><li>a lot of time and perhaps also<\/li><li>high travel expenses<\/li><\/ul><p>If the maximum consideration is taken, the costs are in the order of magnitude of the litigation cost risk in the first instance.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<section class=\"elementor-section elementor-inner-section elementor-element elementor-element-1db0d8a elementor-section-boxed elementor-section-height-default elementor-section-height-default\" class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Therefore, as a party, you must carefully consider whether you need an expert report if the amounts in dispute are low.<\/p><p>For example, if an old machine is to be inspected as shown in Figure 3, the expert costs will be identical compared to the same task on a new machine of the same type. If the <a href=\"https:\/\/maschinenkanzlei.de\/en\/current-value-of-machine-investment-in-case-of-liability-damage\/\" data-wpil-monitor-id=\"48\">current value<\/a> of the machine is low, the costs for an expert report on an old machine are relatively high. Are the costs for court reports or party reports worth it? The clients have to decide that. A good expert will point out this fact when dealing with <a href=\"https:\/\/maschinenkanzlei.de\/en\/buying-used-industrial-machine-risk\/\" data-wpil-monitor-id=\"126\">old machines<\/a> .<\/p><p>As can be seen in Figure 9, the expert costs or the \u201ccosts of machine reports\u201d for small amounts in dispute can exceed the litigation cost risk in the first instance.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-adfe495 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"adfe495\" data-element_type=\"section\" party: assumption of costs<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4df10c6 elementor-widget elementor-widget-text-editor\" data-id=\"4df10c6\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>As already explained, expert reports are not only required on behalf of courts, but also on behalf of commercial companies, industrial companies and insurance companies.<\/p><p>They are usually commissioned when there is a <a href=\"https:\/\/maschinenkanzlei.de\/en\/insured-sum-insurance-value-machines\/\" data-wpil-monitor-id=\"4\">damage case in the area of \u201c <em>machinery<\/em> <em>and equipment<\/em> \u201d or in mechanical engineering<\/a> .<\/p><p>Damage is understood as meaning<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<section class=\"elementor-section elementor-inner-section elementor-element elementor-element-8d75140 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"8d75140\" data-element_type=\"section\" If necessary, the causes will be determined and the expected costs of restoring the original condition will be stated. It is not possible to estimate these costs precisely in advance as an expert for damage to machines and mechanical engineering.<\/p><p>However, experience already makes it possible to roughly limit the cost framework. Section 7 in particular shows that expert reports are generally always worthwhile in mechanical engineering with regard to the risk of litigation costs for damages of \u20ac20,000 or more. I am of the opinion that it makes little sense for damages that are less than \u20ac10,000.00.
